Developing Trends in ESG\u00a0disputes:<\/strong><\/em>
\nAre climate litigation, diligence laws, geopolitical uncertainty, and emerging technologies creating new ESG risks for transatlantic business?<\/em><\/p>\n

 <\/p>\n

Transatlantic<\/span> businesses<\/span> are<\/span> facing<\/span> several<\/span> new<\/span> legal<\/span> concerns<\/span> related<\/span> to<\/span> ESG (Environmental,\u00a0<\/span>Social, and Governance) standards. From failures to commit to net zero operations, like alleged\u00a0<\/span>against Shell, to the possibility of false claims cases for so-called \u201cgreenwashing\u201d business\u00a0<\/span>operations, as threatened against KLM, <\/span>climate <\/span>litigation<\/span> has become an increasingly invoked tool\u00a0<\/span>as a way to fight against climate change. <\/span><\/p>\n

ESG standards have also led to the risk of shareholder activism against corporations, with\u00a0<\/span>paradoxical results. Shareholders may allege that a corporation\u2019s failure to fulfill ESG ambitions\u00a0<\/span>violate their duties to comply with vigilance laws; while investment funds (like BlackRock or\u00a0<\/span>Vanguard) that have made ESG projects a priority are suffering from increased regulatory scrutiny\u00a0<\/span>and the risk of legal claims. Corporate boards are increasingly subject to diversity requirements,\u00a0<\/span>although these standards may give rise to discrimination or unfair practices claims.<\/span><\/p>\n

Claudia Salomon, will join us for an introductory, fireside chat to touch on these subjects in her experience as President of the ICC Court of International Arbitration and the role arbitration can play in resolving climate change and other ESG-related disputes.<\/p>\n

A panel will then explore the various legal challenges that businesses may encounter, including\u00a0possible legal action against polluting operations, supply chain issues raising human rights claims,\u00a0alleged failures to commit to net zero operations, false claim cases for so-called \u00ab\u00a0greenwashing\u00a0\u00bb,\u00a0and shareholder claims arising from alleged or proven ESG shortcomings.<\/p>\n
