Opening a path of negotiation toward more tariff-free transatlantic trade.\u00a0<\/em><\/h4>

In the famous transatlantic dispute dating back to 2004 linked to the fierce competition between AirBus and Boeing, the State-parties concerned (notably France, the European Union and the United States) accused each other of illegally providing subsidies to these two airline manufacturers. After bringing the dispute to the WTO and its dispute settlement mechanism, the parties were authorized to adopt a number of trade measures and countermeasures.<\/p>

In October 2019, the WTO assessed the damage suffered by the United States at $7.5 billion and authorized an American countermeasure to impose a surtax on certain products, including French wines at 25% of their value upon entry into the United States. For its part, the European Union obtained authorization from the WTO in October 2020 to impose additional tariffs in the amount of 4 billion dollars.<\/p>

Both sides have suffered from these measures, as the surtaxes fall on the consumers. In fact, importers pay the additional duties and are therefore forced to adjust prices. French wine producers were also forced to adjust their prices and potentially lost significant market share, as wines from Italy or Australia for instance were not subject to the surtaxes.\u00a0As specialists in European customs law, we assist numerous importers and exporters in these matters.<\/p>

However, the new American administration\u00a0of Joe Biden, is not following the policy initiated by the \u00ab\u00a0Tariff Man\u00a0\u00bb and has committed itself to a path of negotiation with the European Union by signing an agreement on March 4, 2021 to suspend the measures adopted by both sides (including the surtaxes) for a period of four months from March 10, 2021. This gesture of goodwill should allow for a peaceful negotiation to settlet \u00a0this already over 16-year-old dispute.\u00a0Other measures may potentially be suspended in the coming months and we remain at your disposal to assist you on these issues, if necessary. Ouvrir une voie de n\u00e9gociation vers un commerce transatlantique plus exempt de droits de douane.<\/b><\/p>

Dans le fameux diff\u00e9rend transatlantique datant de 2004 li\u00e9 \u00e0 la concurrence f\u00e9roce entre AirBus et Boeing, les \u00c9tats-parties concern\u00e9s (notamment la France, l’Union europ\u00e9enne et les \u00c9tats-Unis) s’accusaient mutuellement de subventionner ill\u00e9galement ces deux constructeurs a\u00e9riens. Apr\u00e8s avoir port\u00e9 le diff\u00e9rend devant l’OMC et son m\u00e9canisme de r\u00e8glement des diff\u00e9rends, les parties ont \u00e9t\u00e9 autoris\u00e9es \u00e0 adopter un certain nombre de mesures commerciales et de contre-mesures.<\/p>

En octobre 2019, l’OMC a \u00e9valu\u00e9 le pr\u00e9judice subi par les \u00c9tats-Unis \u00e0 7,5 milliards de dollars et a autoris\u00e9 une contre-mesure am\u00e9ricaine pour imposer une surtaxe sur certains produits, dont les vins fran\u00e7ais \u00e0 25 % de leur valeur \u00e0 l’entr\u00e9e aux \u00c9tats-Unis. De son c\u00f4t\u00e9, l’Union europ\u00e9enne a obtenu l’autorisation de l’OMC en octobre 2020 pour imposer des droits de douane suppl\u00e9mentaires d’un montant de 4 milliards de dollars.<\/p>

Les deux parties ont souffert de ces mesures, car les surtaxes retombent sur les consommateurs. En fait, les importateurs paient les droits suppl\u00e9mentaires et sont donc contraints d’ajuster les prix. Les viticulteurs fran\u00e7ais ont \u00e9galement \u00e9t\u00e9 contraints d’ajuster leurs prix et ont potentiellement perdu des parts de march\u00e9 importantes, les vins d’Italie ou d’Australie par exemple n’\u00e9tant pas soumis aux surtaxes. En tant que sp\u00e9cialistes du droit douanier europ\u00e9en, nous assistons de nombreux importateurs et exportateurs sur ces questions.<\/p>

Cependant, la nouvelle administration am\u00e9ricaine de Joe Biden, ne suit pas la politique initi\u00e9e par le \u00ab Tariff Man \u00bb et s’est engag\u00e9e dans une voie de n\u00e9gociation avec l’Union europ\u00e9enne en signant un accord le 4 mars 2021 pour suspendre les mesures adopt\u00e9es par de part et d’autre (y compris les surtaxes) pour une dur\u00e9e de quatre mois \u00e0 compter du 10 mars 2021.
